Court awards 10-year rigorous imprisonment under NDPS Act
Ferozepur, December 8, 2019: The Ferozepur district court has awarded rigorous imprisonment (RI) of 10 years to an accused for having committed offence under Section 15 of Narcotic Drugs and Psychotropic Substances Act, 1985 – NDPS Act.
According to case details, on November 9, 2017, the police party headed by SI Mohit Dhawan was on patrolling and checking of suspected persons. The secret informed had given the information and Sukhdev Singh, Gurdev Singh were indulged in the business of selling poppy husk. On reaching the designated spot, 160 kg poppy husk was recovered from persons,40 kg each from Gurdev Singh in four plastic bags, Sukhdev Singh in two bags, Hira Singh in five bags and Baljit Singh in four bags. Further on conducting the search of he truck, currency notes of Rs.2.50 lacs were also recovered from the dashboard.
In all, 10 Prosecution Witnesses and 5 Defence Evidence were produced in the court of Sachin Sharma, Judge Special Court, Ferozepur and statements were recorded under section 313 Cr.PC.
After going through the PWs and DWs and sufficient, consistent and cogent evidence on record, led by prosecution, the guilt of accused was provided beyond shadow of reasonable doubt and accused was found in conscious possession of 160 kg of poppy husk without any legal permit or license.
The court held him guilty for the offence punishment under section 15 of the NDPS Act and deemed it appropriate to sentence the convict Gurdev Singh with rigorous imprisonment for a period of ten years and to pay a fine of Rs.1 lac and in default thereof, to further undergo rigorous imprisonment for a period of one year. However, the period of detention already undergone by the convict during course of investigation or trial shall be set off.
